Do Married Couples Need Separate Wills?
It’s a common question - if you’re married, do you really need two separate Wills?
The simple answer is yes.
Even though you may share finances, property and responsibilities, a Will is a personal legal document, and each person needs their own.
Why Each Person Needs Their Own Will
A Will sets out your individual wishes, including:
- Who inherits your share of assets
- Who you appoint as executors
- Any specific instructions you want followed
Even in a marriage, these decisions belong to each individual.
Having separate Wills ensures that both partners’ wishes are clearly recorded and legally valid.
What About Mirror Wills?
Many married couples choose to have what are known as mirror Wills.
These are two separate Wills that reflect similar wishes - for example, leaving everything to each other, and then to children or family members.
While they are similar, they are still individual documents and can be updated separately if circumstances change.
Planning for the Future
It’s also important to consider what happens after the first partner passes away.
A well-structured Will can help ensure that:
- Assets are protected
- Your wishes continue to be followed
- Your family is properly provided for
This is particularly important where there are children, property, or more complex family situations.
Avoiding Common Misunderstandings
Some couples assume that everything will automatically pass to the surviving partner and then to the family.
While this may happen in some cases, relying on assumptions can lead to complications.
Having clear Wills in place removes uncertainty and ensures everything is handled as intended.
Keeping Things Clear and Simple
Putting Wills in place as a couple is usually straightforward.
You can discuss your wishes together, ensuring everything is aligned, while still having documents that reflect your individual decisions.
