What Is a Lasting Power of Attorney?

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint someone you trust to make decisions on your behalf if you are unable to do so.

While it’s not always something people think about straight away, it can play a very important role in protecting your future.

Why Is a Lasting Power of Attorney Important?

If you lose the ability to make decisions due to illness, injury or conditions such as dementia, no one automatically has the right to act for you - not even close family members.

Without an LPA, your loved ones may face delays and legal processes before they can help.

Having an LPA in place ensures that someone you trust can step in quickly and act in your best interests.

The Two Types of LPA

There are two types of Lasting Power of Attorney:

Property and Financial Affairs

This allows someone to manage your financial matters, such as:

  • Paying bills
  • Managing bank accounts
  • Handling property and investments

Health and Welfare

This covers decisions about your care, including:

  • Medical treatment
  • Living arrangements
  • Day-to-day wellbeing

You can choose to have one or both, depending on your needs.

When Should You Set One Up?

The key point is that an LPA must be set up while you still have mental capacity.

Waiting until it is needed can be too late.

Many people choose to arrange this alongside their Will, so everything is in place for the future.

Choosing the Right Person

Your attorney should be someone you trust to act in your best interests.

This is often a partner, family member or close friend. It’s important to choose someone who understands your wishes and is comfortable taking on the responsibility.

Keeping Things Simple

Although it may sound complex, setting up a Lasting Power of Attorney is usually straightforward with the right guidance.

Everything can be explained clearly, so you feel confident in the decisions you are making.

Peace of Mind for the Future

Having a Lasting Power of Attorney in place means:

  • You stay in control of who makes decisions
  • Your wishes are respected
  • Your family can act without unnecessary delay

It’s a simple step that provides lasting reassurance.
